Trailer Rental Agreement

This Trailer Rental Agreement ("Agreement") is entered into between Trailer City Express Inc. ("Company") and the Renter identified below. By signing this Agreement, the Renter acknowledges that they have read, understood, and agreed to all terms and conditions.

1. Loss or Damage to Trailer

The Renter shall be responsible for all loss, damage, theft, mechanical repairs, recovery costs, towing charges, and associated expenses resulting from misuse, abuse, negligence, improper operation, or failure to comply with this Agreement.

The Renter agrees to pay loss-of-use charges equal to the regular daily rental rate for each day the trailer is unavailable for rental due to damage, repairs, theft, or recovery, regardless of fault.

4. Accidents, Damage, and Theft

The Renter must immediately report any accident, theft, damage, or loss involving the trailer to the appropriate authorities and Trailer City Express Inc. A written incident report must be completed within 24 hours.

The Renter agrees to pay all rental charges, fees, damages, penalties, deposits, and other costs associated with the rental. If a third party fails to make payment on the Renter's behalf, the Renter remains fully responsible for all charges.

6. Traffic Violations, Tolls, and Administrative Fees

The Renter is responsible for:

An administrative fee of 10% may be added to any charges processed by Trailer City Express Inc.

7. Repossession

Trailer City Express Inc. reserves the right to terminate this Agreement and repossess the trailer without notice if the Agreement is violated or if the trailer is considered at risk.

8. Personal Property

Trailer City Express Inc. is not responsible for any loss, theft, or damage to personal property left in, on, or transported by the trailer.

9. Loading and Cargo Responsibility

The Renter is solely responsible for ensuring all loads are properly distributed, secured, and within the trailer's rated capacity. The Renter shall be liable for all damages resulting from overloading, improper loading, or unsecured cargo.

10. Tow Vehicle Requirements

11. Delays, Breakdowns, and Flat Tires

Trailer City Express Inc. shall not be liable for loss of time, wages, inconvenience, missed appointments, project delays, or any consequential damages arising from trailer breakdowns or mechanical issues.

Trailers may be equipped with a spare tire. The Renter is responsible for any roadside tire service costs.

12. Licenses and Permits

The Renter is responsible for ensuring compliance with all applicable laws, licenses, permits, inspections, and towing requirements. This includes any required annual safety inspections for the tow vehicle.

13. Security Deposit

A refundable security deposit of $300.00 is required. The deposit may be used to cover damages, cleaning fees, missing equipment, late fees, and unpaid rental charges. The remaining balance, if any, will be refunded after inspection of the trailer.

14. Late Return Fee

Trailers returned after the agreed return time without prior approval will be charged a late fee of $25.00 per hour. Additional rental charges may also apply.

15. Cleaning Fee

Trailers must be returned clean and empty. Cleaning fees ranging from $25.00 to $750.00 may be charged for excessive dirt, mud, debris, construction materials, asphalt, concrete residue, garbage, or any other condition requiring additional cleaning.

16. Inspection

The Renter acknowledges that they have inspected the trailer prior to departure and found it to be in safe and acceptable condition. Any existing damage must be documented before leaving the rental location.

17. Authorization to Charge Credit Card

The Renter authorizes Trailer City Express Inc. to charge the credit card provided for any amounts owing under this Agreement, including but not limited to:

The Renter agrees that Trailer City Express Inc. may process these charges without obtaining additional authorization if such charges arise from the rental period covered by this Agreement.

The Renter further agrees that any disputed charges shall not relieve the Renter of their obligations under this Agreement and that Trailer City Express Inc. reserves the right to pursue any unpaid balance through legal means.

The credit card holder signing below confirms they are authorized to use the card provided and accept responsibility for all charges arising from this rental.

18. Administrative Fees

The Renter agrees that Trailer City Express Inc. may charge an administrative fee of up to $75.00 per occurrence in addition to any actual costs incurred for services including, but not limited to:

The administrative fee is intended to compensate Trailer City Express Inc. for time and expenses associated with handling these matters and shall be payable in addition to any fines, penalties, repair costs, towing charges, legal fees, or other amounts owing under this Agreement.

19. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

The Renter agrees that any dispute, claim, or legal proceeding arising from or related to this Agreement, the rental of the trailer, or the use of the trailer shall be brought exclusively before the courts of Ontario.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by Trailer City Express Inc. to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

20. Tires, Wheels, and Roadside Damage

The Renter acknowledges that the trailer's tires, wheels, and related components are in good condition at the commencement of the rental period.

The Renter is responsible for any tire, wheel, rim, hub, valve stem, bearing, suspension, or related damage occurring during the rental period, including but not limited to:

The Renter shall be responsible for all repair and replacement costs associated with such damage.

Trailer City Express Inc. does not provide roadside assistance and is not responsible for any expenses incurred by the Renter for roadside service, towing, tire replacement, delays, lost time, accommodations, or other related costs.

The Renter must immediately notify Trailer City Express Inc. of any tire, wheel, bearing, or suspension damage occurring during the rental period. Continued operation of a damaged trailer may result in additional charges for any resulting damage.

SECTION TWO

Waiver and Release of Liability

The Renter voluntarily assumes all risks associated with the use, loading, towing, and operation of the trailer.

The Renter hereby releases, waives, and discharges Trailer City Express Inc., its owners, employees, agents, and representatives from any and all liability for personal injury, death, property damage, loss, theft, or claims arising from the use or possession of the trailer.

The Renter further agrees to indemnify and hold harmless Trailer City Express Inc. from any claims, lawsuits, damages, costs, legal fees, or liabilities arising from the actions of the Renter or any person using the trailer during the rental period.
